Hello everyone,
It is extremely unfortunate but I have lost my green card. I can�t seem to find it anywhere. I know that it has not been stolen, just lost! I need to apply for a replacement green card ASAP. I need to submit some initial documents along with my I-90 form for it. I have been trying to search on the internet regarding it but I can�t seem to find a clear answer.
Long story short, could somebody please tell me what initial documents are there to submit along with my I-90 form? I have a copy of my original green card, but is there anything else required? Am I required to submit my photos along with my form?
I would highly appreciate if someone could reply to my queries ASAP.

Thanks. Yes it is within driving distance, just the city is different.
I was tensed because I didn't know the right answer.
With all the H1 issues going on nowadays because of location, I wanted to confirm.
Say when I file my H1 extension, then the employer address is the going to be the new one, in the LCA.
So was concerned if it will raise any red flags.
What do you all think?

I entered USA in Dec. 2007 on H4 Visa valid till April 2010. I got my H1B approved in October 2008. I worked for few months, and due to bad economy I do not have any project since last 5 months and also no paystubs. I would like to change back to H4 status. But I understand that filing for change of status from within US might require latest paystubs. So I am planning to go to my Home country this month ( Nov 2009 ) and return in Jan 2010.
My questions are:
1) The H4 visa stamp on my passport is valid till Apr 2010. So can I simply enter USA with the same stamp and valid H1b petition from my spouse to get the new valid I-94 in H4 status?
2) Will there be any issue at Port of Entry ? Has anyone done this before ?
3) If this can be done then once I get valid I-94 with H4 status, Do I need to file any other form in addition like I-539 to be in proper status ?

I thought they changed their mindset from having no movement most of the year then jumping ahead several years in the last quarter and playing catch up.. this is what got them the 07 fiasco

Seriously, I was disappointed with the JAN 09 VB. I am thinking of applying for EB3 to EB2 but I don't know if I can do that. I had two years experience before joining my current employer and now I have served almost 6 years with them that bring it to total of 8 years.

Thanks for the quick reply. I was reading that getting approved I129 means you are cap exempt for next 6 years. As the petition for visa was filed in 2007, so according to this cap exemption should be for next 6 years i.e. 2013. Would be really nice if you can clarify this.

Affadivit for Birth certificates from parents will be fine. you must have 2 affadivits for the missing birth certificates stating the reason for non availability of birth certificates, person's relationship with the applicant and the circumstances for knowledge of birth. It is always advisible to provide additional documents like school leaving certificates etc.. as proof of birth date, place and parents names along with affadivit to substantiate the evidance in support for missing birth certificate.

I'm seeking second opinion for my situation.
My H1b visa has been extended for another 3yrs and my current stamped visa expires sept 2010. I work for a typical consulting company with a client at end and a vendor in the middle. I've a clean record and have been paid always for last 3yrs, without a single month gap.
I'm visiting India in June for marriage so I wanted to go for the stamping as well. I've a situation where I'm looking for a second opinion.
What would you do if you were in my situation:
1. Go for visa stamping alone immediately after landing in India before marriage. Marriage is about 8-9 days after I land there. And, my spouse can go for H4 visa alone after marriage once marriage certificate is ready.
2. Go for visa stamping after marriage with spouse as well. But I'll have only 7-8 business days based on the latest dates available after marriage.
3. Don't go for stamping as I can return with a valid visa and I-797. My spouse can go alone after.
I'm tending towards #2 just because if I do get stuck for some reason, I doubt they will process my application within 2-3 weeks without needing to alter the travel plan when I go with #1. So, either #1 or #2, if I've a situation in stamping then I doubt anything will get settled just in 2-3 weeks.
I want to go with my wife just because I'll have one less work to get done and we can plan her transition from existing job.
What will you do given same situation? Any risk that you see?

i think majority of the Eb2 filings are under audit..
i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.

Hello all,
I applied for I485 + I150 in June 2007 under EB3. My I-140 is still pending.
Employer used a preappr labor with PD of May 2005. However, the lawyer gave me only the ETA 750B portion of the labor to fill
Now, from some forum I found out that PERM was started in March 2006 and the form was 9089 to be used for labor after march 2005 filings.
So, how did my employer file my labor using ETA750B part which was applicable for old labors ?

I've been reading a lot regarding how many people is submitting their application this month, some how after see the possible figures I feel demoralized, looks like before July 2007 all of us were having an idea of our process, then the USCIS mess appeared and now I have no idea of when I will receive the GC or if some day I will receive it.
The USCIS just gave us the sense of advancement but in reality they did not giveus anything, just look the facts, you will have EAD and PAD, but if your I140 or I485 fail then you will be ouf of status, so many people will decide to maintain their H1B status, so why did we apply?
Can any one elaborate or give an estimate of when will we be receiving our GC (whe nI say we I'm thinking in all the people applying under the Visa Bulletin 2007 mess).

I think he has suggested you for Good. And take a look at the add what they have given for LC. If this says you need MBA then you can go for Eb2 else you cannot.
I another case a guy had 10yrs experiece but job requirement asked for 1 yr so they have to go for EB3.

I filed for I-485 in mid-June 2007 but never received the receipt notice
(due to the issue described in this thread: http://immigrationvoice.org/forum/showthread.php?t=11788&highlight=undeliverable).
After months of calling USCIS (probably called at least 10-15 times over past 6 months) and having the lawyer send a written letter, I still did not receive the receipt notice as the customer service reps kept telling me that USCIS doesn't send a duplicate receipt notice.
When I saw that one of my friends who had the same issue received a "Replacement Receipt Notice" after calling them numerous times, I decided to call them again. I was able to convince one of the reps to put in a service request requesting "resend whatever was returned to USCIS as undeliverable".
I finally received a letter from USCIS that they will resend the receipt notice but it has been a few weeks since then and I still have not received the promised receipt notice.
Now I need to file for EAD ASAP but it requires you to attach the receipt notice (Notice of Action I-797C or I-797??).
(lawyer didn't file for EAD with I-485 as I have H1)
So my question is:
Can I use the Biometric appointment notice (ASC Appointment Notice I-797C) instead of I-485 Receipt Notice I-797 to file EAD form I-765 as a proof that I filed I-485 ?
What are the odds that they will send my EAD application back saying that I need the actual I-485 receipt notice?
What are my options?

USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...
That is because their entire revenue comes from filing fees (2.5 billion out of the 2.6 billion dollars). Why would they make changes when they get easy money? It is a win-win for them - by both delaying the processing of the original application and by reducing the validity of the interim benefits, they prolong the money flow.
Don't expect any reform from Congress because they are the ones who allocated the filing fees revenue to pay for the USCIS expenditure.

Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.

The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. The SEVP procedures differ among U.S. Consulates/Embassies; contact your U.S. Consulate/Embassy NOW to determine its particular procedure on applying for a visa before planning for the interview.

How early can I start working. If I am correct usually I have to wait until I get receipt for USCIS before I can start working for another company. But with H1B from university should I have wait till it gets approved?
