hi gurus,
please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.

help filing EAD AND AP after rejection

My EAD and AP application got rejected because of missing signature on the form.Now i am planning to file on my own with out the help of attorney as he is charging me too much for refile.
So needed help in drafting the letter addressing the situation.Above all i didn't receive my application back and USCIS personnel told me that i can refile as a fresh application if i don't receive in 30days.And i am already completed the 30days.I do have the rejected application LIN number and my 485 receipt.
Please advice me what to do i want to avoid attorney.

How did you come to know that your EAD and AP were rejected? When you dont have the receipt #? In my situation my stupid attorney didnt include the I-140 receipt number dont know if they will accept the rest of the application, my I-140 has been approved.

It appears you changed jobs using AC21 and went on to receive your GC. If correct, could you please post your timeline and experience?

I guess posting this was the trigger for USCIS to send the approval. I got the CPO mail in my email a few mins ago!

In my job search (banking and finance jobs) there is this one question i come across on each and every job application-
"Do you now or will you in the future require sponsorship to legally work in the united states?"
and options to tick on the form are 'yes' or 'no' with no space for explanation.
So i mark 'yes' and i guess thats where my job applications get stuck.
Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?
I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.
I want to know whether i am legally required to say 'yes' beacuse i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)
OR
Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.
I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.
(There is a separate question that asks if i am legally allowed to work in the US and i answer 'yes' to that since i have an EAD)

The policies that are supposed to help recovery are being worked on and will take time to show results. Remember nobody felt the recession until 1 year after it actually started. My labor was filed with job title from the employer as IT Lead (O*Net Code - 11-3021.00, O*Net title - Computer and Information Systems Managers). I am having an opportunity to convert to full-time on EAD (I-140 approved, EAD received 18months back). The new job title is Software Engineer(possible O*Net codes - 15-1032.00/15-1021.00/15-1031.00, possible O*Net title - Computer Software Engineer/Computer Programmer). Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.

your interview will be scheduled in the 2011 fiscal yr which starts in october.
you can adjust the status in the u.s but be careful with this as the backlog can make it a long wait or you can go home or to the country of last foreign residence and get it done the same day.
any extra questions, send me a private note - i am very familiar with this process.
in the meantime, start collecting your documents for the interview as instructed in the package you will have received.

For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:

You can move you H1B visa from Company A to Company B. Talk to your attorney. Because you already have an approved H1 you will not be subject to H1 cap while applying for H1 through Company B.
I do not think Company A can apply for a H1 extension based on I140 and I485 of comapny B. But ask your attorney as to what your options are

For EB3 case, after receiving the approval for I 140, I know that we have to wait till DOL Proiority Date is current to be able to file for I485.
If we decide to receive the green card in any consulars overseas, can we just go ahead and file the I485 after getting the I140 approval? (without waiting for PD to be current)
Any advice would be appreciated?
