You have to go through the same process as a New H1B and it stamped in INDIA again and also get in touch with your new employer he should be able to give you the info you need. Their is no new form to be filled in.

I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?

I posted the same kind of question in murthy forum and I got a reply that education requirement is not needed once I140 is approved which determines EB2/EB3. So I guess we can port to any job which is similar/same. Don't take my word and do your own research for exact info.

You must be actually in H-1B status in order to use the H-1B portability provisions. This is what allows you to start with Company B once their H-1B petition is filed, rather than wait until the petition is approved. To use this, you need to get into H-1B status for Company A 9either through a COS petition or by entering the US in H-1B status. I don't recommend that latter option if you know that you will be changing employers as soon as you enter the US.
Alternatively, you could change from Co. A L-1 to Co. B H-1B, but you cannot start working for Co. B till the COS is approved.

I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.
Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?

Greetings everyone.
I ran into these forums few days ago and realized what I have been missing for the past few years :-). Anyway, my GC priority date is Nov 2005 under EB2 (India). I am very GC-illiterate in the sense that after actively tracking and monitoring it for a year or so after filing for labor, I kind of gave up on the fact that I was going to get GC anytime soon and moved on. Except for replying to lawyer's emails whenever I get them, I didn't really monitor anything else. Anyway, here is some additional information -
1) I applied along with everyone else in July 2007 for I-485 and got my EAD.
2) I went for VISA stamping in Hyderabad in Nov 2009 and got 221(g) (I had all the documents but you know how 221(g)s were given out at Hyd like M&Ms at that time) and upon lawyer's recommendation entered the country through AP.
3) A part of my company was recently acquired by a different very large MNC and I chose to remain in the other half which wasn't acquired and we chose to do business as (DBA) as a different company. Lawyer said she took care of it on the GC app - I am guessing she filed for AC-21.
4) I currently applied for a EAD (current one expires in couple of months) and AP.
Long story short, my app status currently shows, "post-decision activity" -->Does it mean they already took the decision? Is there a chance something could go wrong in the next few weeks? I called the lawyer's office yesterday and they said I should hear from them in the first week of August and if the app status doesn't change, they will open a SR on my behalf around Aug 10th...
Any help is greatly appreciated.

The has to be physically present in the US to apply for 485. If she does not have a passport then she cannot file for 485.

If a College fresh guy gets Rs 6,00,000 / yr at bangalore what will be the salary of a 10yr experienced developer 5 years down the line when the talents will move back ?
In fact I�m sure 10yr experienced can immediately mandate a salary of Rs 30,00,000 /yr at Bgl �. You will save almost the same that you are saving here.

Hi Guys,
I have recently got married and entered US on AP, I have not used my EAD and started working for the same employer (GC sponsered). My wife is going for H4 Stamping in US consulate in India. Does any one has any experience? Do you see any problem during Stamping.

As long as you have a clean immigration track record (no out of status, continous pay) - your wife should not have any issues in H4 stamping and there may be administrative delays (like PIMS and etc), which no one has control over it.

We have asked for an amendment to allow applicants to file for I 485 even when the dates are not current so that EAD can also be filed (which gives portability).

Can my employer use the same recruiting documentation used for this perm to file new perm for me under EB2 since both positions are w/ same title & description & same employer. They do random inspection on applications. Some people who have no work permit are being inspected if they are working illegally and some are found to be.....even if they do not accept pay or just saying they are volunteers.....
I guess you're being inspected. If you're not working without a work permit, you should be ok.
I am not working at all. But what about Interim EAD. Can I get while waiting for FBI clearence and hold on the application

So basically while I'm waiting for the priority date to become current, I can legally work aborad for several years without any harm to my GC application at all. When the priority date becomes current, I'll just need to come back to the U.S. to file I-485.
Is that correct? Sorry for keeping asking. Just want to make sure before I make this major decision.
