Since USCIS started I-140 premium processing service on 06/29/09, you can try and upgrade your pending I-140 to premium processing so you can get a decision on your case within 15 days...When you get your I-140 approval, you can file for a 3 yr H1 extension based on it.

I was in EB2 with 485 pending. I applied in EB1 and had 140 approved. I asked USCIS to approve pending 485 based on EB1 140. My GC was approved but wife's petition, pending at another field office, was denied and the officer said there is nothing like linking pending 485!
Can we use the pearson memo to justify our case? The memo says both the petition dates should have current priority dates?!? Is that correct? Are there any other memos we can use to make our case? My wife cannot file another 485 as she does not have a non immigrant status.

HI IM 17 years old my dad applied for my green card and it been 3 years i still did not get it they had sent me to go get my fingerprint taken but i had ran away home and missed the appointment date my sister just got her approval.please can someone help or advise me im almost done with school and i wanna attend college and get a job

to send applications to a wrong center and they'll(USCIS) move it around.

was your 140 approved at TSC? i read somewhere that 485 goes to the same place where 140 was approved. you may want to ask your attorney why they sent to TSC

I am getting ready to n-470 to preserve residency. My company is sending me to UAE for one week period which will leads to other long back and forth trips there. I need to file n-470 to preserve residency for naturalization. I have already lived here for more than one year as a permanent resident. My questions are:
1. Where do I find a sample communication letter as a support document?
2. What do I write in it?

In general, I see a lot of members quoting stuff that indicates shortage of tech workers and saying we should use them.
While this is true, it is worth understanding/appreciating the fact that most of these articles are aimed towards increasing H1 quota and not necessarily improving EB retrogression.
We should be a little careful which articles we use.

Does the new Quota start Monday Oct 1 st?? Can we see approvals coming right away or will USCIS take some time to access the number of application received and then request the visa numbers..
Also did USCIS use up all numbers for 2007?

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

I am in similar boat. What does your lawyer say? I am waiting for my lawyer response. How about option on interfiling NIW 140 with the pending I-485. That is do not file new I-485 but change underlined I-140 in the old one. Ask your lawyer about that and let us also know whats his/her response.

Yes, unfortunately that is true. You can not use the experience that you gained with the current sponsoring emplloyer for your permanent residency application.

I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?

I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).
Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?
I will need to send to USCIS today. Please let me know ASAP.

ie., I got One on Mar 18th and the othe LUD on Mar 25. What dows this mean.
Can somebody clarify...
It seems that whenever they open file a LUD is generated, e.g.
..FP done
..FP Oked
..I sent docs for e-filed EAD, when they received they put a LUD
Soft LUD is happening amounts to some activity happening with file/case.
ie., I got One on Mar 18th and the othe LUD on Mar 25. What dows this mean.
