Are there instances where the processing time before interview will exceed to more than 3 mos? Is it also true that during the embassy interview, you are currently working? I am a nurse and my agency told me that I should still be practicing as a nurse during the time my packet 4 comes.
I'm really having some problems because I am intending to go to Ireland by June. But now here comes the Mar 1, 06 PD. What if it would take me again another year to wait for my US visa. I am really sick of waiting.

I am considering switching my employer.
Currently I have I-140 and labor for GC approved in 2006.
Filed I-485 in July 2007.
My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)
Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?
Appreciate your answers in advance.

The sad part about the Brokow's report is that he focused on H1B issue and not the real problem which is the green card issue.
Yes, people come on H1B - however, for those immigrants to put down the roots, it has to happen through green cards and not H1B extensions (neither one of which was mentioned in the report). I am not sure if this is a two part series, but it should be.
IV members should write to MSNBC Nightly News to do a more in depth story on immigration problems of the high skilled immigrants.

My mother had green card through my sister who is US Citizen. four years ago my mother wen to India and did not came back. after 6 years she again came back on visitors visa.
we want to renew her greencard.

Hi,
is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:

Whats your PD? If you are on H1, have a stamping and already have the 485 receipt, the only possible issue with travel is if your 485 gets approved when you are abroad. People have still managed to enter on H1 as PoE officer apparently does not realize about your 485 approval.
If its a recent PD, then no issues, you can travel (Actually my lawyer told me I can travel even without getting the 485 receipt, but thats apparently a bit of a grey area)

For the past 10 to 13 years people are waiting on the EB category Queue, and they are all tax payers as same as US Citizen.
some of them are in H1B status, in this economy it is not necessary that they should always have a job, so if the congress
is not acting on the Immigration bill as soon as possible, they are making the Legals also Illegals pretty soon, with the
USCIS nasty memo for the Employer-Employee relationship, getting an H1 extension became another Oil spill in the Gulf Coast!
This is not a joke, and politicians care little about this, because they cannot manipulate anything here, This is the year and time
to pass immigration bill. If not then immigration issue may not see light.
What about great Indian origin media tycoons Sanjay Gupta & Fareed Sakaria, why cant they make a issue on the media about this.
All Indian origins except some bunch of people, are waste and just eat, drink & be merry caes, and they don't care for anything.

Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

If new position is similar in responsibilities, then no effect. but if the responsibilities are changing, I would recommend talking to your immigration lawyer about it
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

I think approved I-140 is the right stage. Why do we have to live in uncertainty after an application for immigration has been approved. It also makes sense to request AOS for 5+ years of H1 as well.

You are correct that if you do not maintain valid H-1 status your wife will lose legal status in the US. If she pursues a degree as a FULL TIME student she can file for a COS to F-1. As part of that application she will have to document her valid H-4 status by proving that you are in valid H-1 status with current paystubs and/or letter confirming your employment from your H-1 employer. So it would be safest to file the COS while you are still employed.
