I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

Hi,
Thanks for my previous response. I am on H1B and between projects. I have an offer to work for a couple of days for a company other than the one holding my H1B. They said they are not gonna report to the IRS as its an hourly job for 2 days and the number of hours are not going to accumulate enough for the IRS. But they need my SSN or tax-payer ID to run their payroll. I am gonna receive my dues as a simple check (like a rebate check with just the total amount showing up & NOT a paystub). Please let me know if I can work for them or not.

I am with H-1 visa. Recently, I help another company finish one project, then I received a stipend of $8K. They will send me 1099 misc form for tax purpose. Does it affect my H-1 status and green card application? Thank you.
Do you have EAD? If not, you may be in trouble as H1 does not allow you to do a side job.

Hi,
If names are intercahnged it has to be corrected. It MAY create problems When Name goes for FBI Clearance. Better do it..

Are you really sure that your H1B is still valid? My understanding is, only one type of Visa will be issued to a country for an individual, they cancel previously valid visas.

No worries. As you 140 was approved uscis gave 3year extension. It is not a mistake

Can we apply for I - 485 without having the I -140 receipt notice.What is the work around so that I dont miss the Aug 17,2007 date for filing I -485.Are there any chances that my I - 45 will be rejected, or will I ge an RFE.
My I - 140 was applied during the 2nd week of July, 2007.

I am about to file my I-485, EAD and AP in July. My company (ABC) acquired by investment company (XYZ) 2 months back and changed from public company to private company. My company (ABC) is still exists as an same entity and an independent company but name changed from ABC corporation to ABC LLC, my job description is same and still my pay stubs are from ABC corporation and Tax-id is also same. Do I need to file for I-140 and H1B amendments? If yes, when should I do it? While filing I-485 or after filing I-485 or before filing I-485? What is the impact on I-485 if amendment is not filed?

I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. You can apply again if you have a new employer, or even if the same employer will reapply. However, if you were denied for a reason that is still a problem, such as not having the required degree or experience equivalent, there is no point in reapplying. Good luck.

For the first time I think IV was put ahead of AILA/AILF in immigration issues when it mattered. I think finally immigration community can have sigh of relief because immigrtaion community is not represented by a bunch of attorneys who make money on immigration issues (which are legitamate or not ) but by a grass roots organization of immigrants. Congrats to IV and its members in resolving july visa bulletin fiasco. Long live IV

if the dependent is planning to come back on AP and then start working on EAD, does it mean the primary applicant has to work on EAD or the primary applicant can still continue on H1.

Applied for Non RIR labor during April 2004 under EB2 in Ohio. Employer changed address (in same city) and one year before. Last week I came to know that Dallas BEC closed my labor case since they didnot recd the 45 day letter response from my employer. My employer requested Dallas BEC (with proof of informing them the address change) last week to re-open my labor case to continue processing the labor approval. My employer says it's better to apply for a new PERM as a backup.
Can the IV members advise me how to proceed on this?
