I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?

You may apply for AP at any time right? If you apply now, it is very unlikely that you will receive before your June end travel. And if you don't get your GC in june what will you do ? see, it is very easy to ask confusing questions. :)

You can apply for multiple H1B at the same time. No need to pay Company but they will aks you to join once H1B gets approved. so at that point you need to decide which one is better for you. You can work for both of them if one of them is ready to offer you part time work. Please Get attorney advice on that part.

But I do not want to loose my H1B status, mean not to use EAD.It has been almost 1.5 year since I140 approved but I never work for the company who filed greencard for me. Does it matter? What is final solution to get greencard since company is closing.

Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
They never sent any notice to lawyer or me about this.
Today is beyond the 15 days for premium processing.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

We need a handle to kick start a similar plead. In the last one year and quarter here at this forum, I had never seen one that CIS has done injustice to us by mis-interpreting a rule or law or act. If somebody knows otherwise, please state and cite facts. The class action suit ("Schneider vs. Chertoff") was filed by Shusterman on behalf of a group of international doctors in response to CIS regulations implementing the Nursing Relief for Disadvantaged Areas Act of 1999. Section five of the Act provides that "any alien physician" can qualify for a green card through a "National Interest Waiver," provided they practice in a federally designated health professional shortage area. The National Interest Waiver program is intended to accelerate the hiring of international doctors willing to serve in such areas.
In its regulations implementing the Act, the CIS stated that only primary care physicians, not medical specialists such as surgeons or radiologists, could qualify for green cards through a National Interest Waiver. The agency's regulations therefore eliminated the right thousands of international specialist physicians had to petition for green cards through the National Interest Waiver program.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?

I am about to file for my 7th year extension with I140 approval. My contract will be renewed with end client, every 6 months and they will not provide me with any client letter, basing on their HR policies. Even if the client gives a letter it will show only a contract for 6 months. Is this needed, that I should produce a client letter for 3 years? My concerns are
1. My primary concern is will the 6 months project length effect my extension for 3 years. Will they extension basing only on the length of the project.
2. Do I need to mention the project length in the letter given by my employer on behalf of client
3. what are the documents relating to client, needs to be submitted for the extension. (I will not be able to produce the client letter, as they are not willing to give)
4. Can I take a letter from vendor, who is in between my employer and the end client. What should be clearly stated in this vendor letter. Is this necessary to mention the project lenght in this letter.

A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?
That would be a huge plus in case its true.
Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

Just wait a few more days and you will receive his I-485 receipt. Some members received online rejection only to find later on that they have been issued a receipt notice.
