Hi,
First my 140 was filed in first week of april and got receipt notice with received date as 11-Apr-08, and in May it was rejected because of check bounce issue.
Again my 140 was refiled in july,and got my 140 receipt notice with received date as 24-Jul-08.
(My labour was approved on 23-Jan-08 and its expiration date is 21-Jul-08,
i think there is rule that 140 should be filed before 180 days of labour approval)
My lawyer is saying:
we first filed it well before the dates,so you should not have a problem, as this is refiled in follow up to the original one.
I am still wondering the USCIS will process my 140.

The United States Immigration and Customs Enforcement (ICE) recently updated (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf) their list of Student and Exchange Visitor Program (SEVP) approved schools. The schools listed have all been certified to participate in the program.
The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. The SEVP procedures differ among U.S. Consulates/Embassies; contact your U.S. Consulate/Embassy NOW to determine its particular procedure on applying for a visa before planning for the interview.
Interested Schools: There is a separate process to obtain F & M Certification. Authorized school officials must obtain and complete Form I-17. I can't really help much, but I would say that going Canon won't actually help (unless you would be happy to use the Canon Digital Photo Professional tools, which is a simpler variant of lightroom, sort of).
New formats of RAW format always needs newer versions of software.

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)
I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.
We probably wont gain anything out of it; at the same time, it doesnt hurt to send them our opinion.

In our 485 notices, Under the section, it is stated as Unknown. priority date is blank. Please let me know if anyone is facing similar situation and what needs to be done to correct it?

My H1B extension was approved for only 6 months, based on the SOW (Client Contract) end date (rather than the usual 3 year extension).
I would be just about in my maternity leave for the pregnancy during the petition expiry and if my further extension is denied (god forbid), I was told that I would be terminated from my employers' payroll and I have to leave the country or change my status to Student, Visitor etc.
FYI: I'm working for this company since Oct 2005.
Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?

I am travelling in June to India, during that trip I have to stamp my H1B visa at Mumbai or Delhi. Does any one has a recent experience at Mumbai consulate about visa interview? Does anyone knows current acceptance percentage at Mumbai or delhi consulate? Is it safer to travel in the economic crisis?
At the same time I have heard some rumors regarding rejection at Port of Entry is that true. Anyone from this group has faced such situation?

I strongly suggest that you do not go for visa stamping (unless there is a family emergency) if you get the new H1B approved. I went for the visa renewal and after nearly 7 months I am still waiting. I am not from any restricted country or have any thing problematic in my name (if you know what I mean). Since these investigations are confidential, I may never know the reason for my situation. From the various forums on this subject, i have gathered that, once you get flagged, you are condemned for life or until you get citizenship. Even if you have done nothing wrong...they like to test your patience again and unfortunately the pleasure is all theirs.
If you have to get stamped, get it from a neutral country such as Canada. A company that can allow you to work from overseas while you are waiting for the visa will help a lot. Also ask your friends to help you with your apartment and other belongings if it takes too long to get the visa. If you do get the visa quickly then just thank your lucky stars for they were more powerful than the VO on that day and time.

Hi,
I need suggestion on travel.
I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.
Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?
As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?
As this is an emergency I need your suggestion please...

You will be using XNA Game Studio (installs into Visual Studio), to develop games. All your time other than for graphics will be spent in Visual Studio 2010. Highly recommend you have a device. Testing in the emulator is not the greatest for games.
Note: All you need is the freely available tools (Express Editions). Having the student or paid versions does not really benefit those using the XNA Game Studio, or building applications for WP7. I'm sure that page says that, just didn't want you to get confused.
If you have done any other game programming you will find everything pretty easy, just takes a bit to get use to. It sounds like you are new to C#, but don't worry most tutorials are setup in a way this shouldn't be a problem.
The MSDN Create site has code samples and there are lengthy tutorials online that will help you get started with XNA.
